FOI and EIR complaints procedure

We operate a separate complaints procedure to deal with expressions of dissatisfaction regarding the outcome of requests for information under the Freedom of Information Act 2000 or the Environmental Information Regulations 2004.


Internal review of your request

If you are unhappy with the way we have handled your request for information, the first step is for us to conduct an internal review. The review will be based on all relevant evidence that was available at the date of your request and conducted by a senior officer who did not deal with the original request.

If you wish to raise a request for a review, please follow the guidelines below. There is no charge for an internal review and to be valid, a request must be:

  • Made in writing (this includes by electronic means)
  • Submitted within 40 working days after the date on which the requester believes the authority breached the requirement concerned

FOI - The Information Commissioner’s Office recommends that public authorities carry out internal reviews within 20 working days (in certain circumstances this can be extended to 40 working days) after the date it receives the representations.

EIR - Under Environmental Information Regulations there is a legal requirement that EIR internal reviews must be carried out as soon as possible and within 40 working days.

  • Email your request to dp@eastleigh.gov.uk; or
  • Put your request in writing to: Legal Services Manager (Internal Review), Eastleigh Borough Council, Eastleigh House, Upper Market Street, Eastleigh SO50 9YN

Information Commissioner’s Office

If you remain dissatisfied with the way in which your request/complaint has been dealt with following the Internal Review, you can send your complaint to the Information Commissioner who will review your case. You can contact the Information Commissioner at the following address:
