Whilst Eastleigh Borough Council wish to support our nation in the World Cup and encourage communities to get together for such events, we also wish to remain respectful to neighbouring properties. We have reminded premises with pavement licences within the borough that if wish to use the deregulated hours their current pavement licence hours cannot be extended.
A pavement licence is a licence granted by the Local Authority (or deemed to have been granted) which allows the licence-holder to place removable furniture over certain highways adjacent to the premises in relation to which the application was made, for certain purposes.
The Levelling Up and Regeneration Act 2023 makes permanent the provisions set out in the Business and Planning Act 2020. These provisions provide a streamlined route for businesses such as cafes, restaurants and bars to secure a licence to place furniture on the highway.
Apply for or renew a pavement licence
Licences will be granted for a maximum period of two years.
- £500 new licence
- £350 renewal licence
Supporting documents
You will need to provide the following documents/information with your application:
- a completed application form;
- payment of the appropriate fee;
- a plan showing the premises, the location and size of the outside area being requested, with the table positions indicated on the plan (if not to scale then clear measurements must be provided);
- details, photographs or brochures of the proposed furniture;
- a risk assessment; and
- a copy of your public liability insurance policy that covers the activity for third party and public liability risks, to a minimum value of £5 million.
Consultation and Determination
Once an application has been confirmed by the Council as valid, the applicant must display a ‘notice of intention’ in the window of the premises. This will be supplied to the applicant by the Council. This must be displayed for 14 days (excluding bank holidays), starting from the day the application is confirmed as valid.
The application and all supporting documents will be sent out for consultation to the Highways Authority and the Police and any other persons it considers appropriate. Members of the public can contact the Council to make representations and the Council will take into account all representations received in the determination of the application. Applications can be viewed during the period of public consultation at the Council Offices at Eastleigh House, Upper Market Street, Eastleigh, SO50 9YN between the hours of 08:30 and 17:00 Monday to Friday (excluding bank and public holidays).
The Council has 28 calendar days from the day after confirmation of a valid application (excluding bank holidays) to consult on and determine the application. This consists of 14 calendar days for public consultation and then 14 calendar days to consider and determine the application. If the Council does not determine the application within that period, the application will be deemed to have been granted under the conditions published.
In determining the licence, the Council may:
- grant the licence in respect of any or all of the purposes specified in the application,
- grant the licence for some or all of the part of the highway specified in the application, and impose conditions, or
- refuse the application.
