FOI and EIR complaints procedure
We operate a separate complaints procedure to deal with complaints involving requests under the Freedom of Information Act 2000 or the Environmental Information Regulations 2004.
If you wish to make a complaint regarding your request for information, be it because you feel that an exemption has been wrongly applied, or the public interest test has been wrongly decided, or your request has not been dealt with in the required 20 working day time limit, please follow the guidelines set out below.
You may wish to contact the Freedom of Information Officer informally, who will be able to tell you why a certain exemption has been applied, or, if your request was one that was refused after the public interest test was applied, why it was applied.
Internal review of your request
If you do not feel that your complaint has been resolved informally and you wish to pursue it further, please write to:
Eastleigh Borough Council
Upper Market Street
Tel: 023 8068 8103
There is no charge for an internal review and to be valid, a request must be:
- made in writing (this includes by electronic means)
- submitted within 40 working days after the date on which the requester believes the authority breached the requirement concerned.
FOI - The Information Commissioner’s Office recommends that public authorities carry out internal reviews within 20 working days (in certain circumstances this can be extended to 40 working days) after the date it receives the representations.
EIR - Under Environmental Regulations Information there is a legal requirement that EIR internal reviews must be carried out as soon as possible and within 40 working days.
