Appeals
If your application has been refused, you do not agree with one
or a number of conditions that have been imposed on your planning
permission, or the Local Planning Authority (LPA) have failed
to decide your application within the set statutory period, you
have the right to appeal.
Appeals are made to and decided by the Planning
Inspectorate, an external and independent government body who will
assess both sides of the appeal, that of the LPA and that of the
appellant, and make a decision based on planning grounds.
The timescales and procedure for the submitting and deciding of
appeals varies dependent upon the nature of the planning
application in question. If your application is refused this
information, as well as guidance on how you can appeal, will be
included with your decision notice. Further guidance on this as
well as other aspects of the appeals process can be found in
the guidance leaflets at the bottom of this page.
Important changes to the Appeal's process came into force
on 6 April 2009. The most significant of which was the
introduction of The Householder Appeal Service
(HAS) which aims to speed up the householder written
representations appeal process. This service will only relate
to householder applications received on or after 6 April 2009.

Submitting an Appeal
Guidance on how to submit your planning appeal can be found on

Please Note: The Inspectorate will
publish details of your appeal on the internet (on the Appeal's
area of the Planning Portal). This may include a copy of the
original planning application form and relevant supporting
documents supplied to the local authority by you or your agent,
together with the completed appeal form and information you submit
to the Planning Inspectorate. Please ensure that you only provide
information, including personal information belonging to you that
you are happy will be made available to others in this way. If you
supply personal information belonging to a third party please
ensure you have their permission to do so. More detailed
information about data protection and privacy matters is available
on the Planning Portal.
How to Comment on a Current Appeal
