Demolition and Dangerous Structures
Any person who wishes to demolish a building or part of a
building with a cubic content exceeding 1750 cubic feet must, under
the provision of Section 80 of The Building Act 1984, give formal
notice of their intention to the Local Authority.
On receipt of a Demolition Notice the Local Authority has six
weeks in which it may serve a counter notice specifying conditions
as appropriate.
Notifiable demolitions should not commence until such time as a
counter notice from the local authority has been received or 6
weeks have expired, whichever is the sooner.
Dangerous Structures
Sections 77 and 78 of The
Building Act 1984
If it appears to a Local Authority that a building or
structure is in such a condition as to be dangerous the Authority
may either, dependant on the severity of the danger:-
- apply to a Magistrates Court to
make an order requiring the owner to make the danger safe (Section
78) or
- request the owner to make IMMEDIATE arrangements to make the
danger safe. If an owner is unable or unwilling
to undertake the works necessary, the Council will arrange to have
the works carried out on the owners behalf on a rechargeable basis
(Section 78).
